Fair terms for
serious digital work.

1. Agreement and eligibility

By accessing or using Testanix, you agree to these Terms, the Privacy Policy and any written order, proposal or institutional agreement that applies to you. You must have legal capacity to agree, or use the service under the authority of a parent, guardian, school, employer or other organization.

2. Accounts and organizations

You must provide accurate information, protect credentials and promptly report unauthorized access. Organizations are responsible for their administrators, permitted users, learner or candidate notices, lawful instructions, and the content and data they submit.

3. Classroom and Talent use

Assessment, monitoring, attendance, reporting and interview tools support educators and hiring teams; they do not replace professional judgment. Users must not impersonate others, compromise assessment integrity, secretly monitor people, discriminate unlawfully, or rely on an automated signal as the sole basis for a consequential decision.

4. Build projects

Build estimates and inquiry responses are not binding until confirmed in a written proposal or agreement. Project scope, milestones, acceptance, ownership, hosting, maintenance, third-party costs and payment terms are governed by that agreement. Changes outside the agreed scope may affect price and delivery.

5. Fees, currency, cancellation and refunds

Applicable fees, taxes, billing cycles and currencies are shown before purchase or agreed in writing. Unless an order states otherwise, paid work already delivered, consumed subscription periods and committed third-party costs are non-refundable. Duplicate or incorrect charges should be reported promptly. Any mandatory consumer right under applicable law remains unaffected.

6. Intellectual property

Testanix and its licensors retain rights in the platform, software, design systems, documentation and trademarks. You retain rights in content you lawfully submit and grant Testanix the limited permission needed to host, process, display and transmit it to provide the service. Project-specific ownership is controlled by the signed Build agreement.

7. Acceptable use

You must follow our Acceptable Use Policy. We may restrict or suspend access where reasonably necessary to protect users, systems, assessment integrity or legal compliance, and will provide notice where appropriate.

8. Third-party services

Some features depend on third-party hosting, email, video, payment, identity or communication services. Their availability and separate terms may apply. Testanix is not responsible for external websites linked from the service.

9. Availability and warranties

We work to keep services secure and available, but maintenance, internet conditions and third-party failures may cause interruption. Except where prohibited by law or expressly promised in writing, services are provided on an “as available” basis without a guarantee that every feature will be uninterrupted or error-free.

10. Liability

To the extent permitted by law, Testanix is not liable for indirect, incidental or consequential loss, lost profits, lost opportunity, or decisions made by institutions, employers or users. Any applicable direct-liability limit will be the amount paid for the affected service during the preceding twelve months, unless a signed agreement or mandatory law states otherwise.

11. Ending service

You may stop using the service at any time, subject to outstanding payment and contractual commitments. Testanix may end or suspend service for material breach, unlawful use, security risk or non-payment. Provisions that by nature should survive termination—including payment, ownership, confidentiality, disclaimers and liability—continue to apply.

12. Governing law and contact

These Terms are governed by the laws of Bangladesh. The parties should first try in good faith to resolve a dispute through written notice; courts with lawful jurisdiction in Dhaka may hear unresolved disputes, unless mandatory law or a written agreement requires otherwise.
