2. Services Covered
These Terms apply to the Testanix website, teacher dashboard, student exam flow, online exam service, online class service, installable web app experience, reports, recordings, and related support services.
Testanix provides tools for teachers, tutors, coaching centres, and institutions to create monitored exams, run interactive live classes, review reports, and manage students. Testanix does not replace the educator's academic judgment or institutional responsibilities.
3. Early-Access Trial and No Automatic Paid Conversion
The early-access trial is free and does not require a credit card. Because no card or payment authorization is collected for the free trial, the trial does not automatically convert into a paid subscription.
When a free trial ends or trial limits are reached, access to some creation, monitoring, storage, or reporting actions may be restricted until the teacher or institution selects and activates a paid plan. Paid plans may require manual activation while online payments are being prepared.
Trial limits may include class hours, student exam attempts, participant capacity, recording or evidence retention, support level, and access to institutional features. Testanix may change trial limits during early access to protect service reliability and improve the product.
4. Subscriptions, Cancellation, and Refunds
Paid plans are measured by the plan selected, including student exam attempts, monitored attempts, class hours, participant capacity, recording storage, evidence retention, and teacher account limits.
You may cancel a paid subscription by contacting support@testanix.com or by using any cancellation control made available in the dashboard. Cancellation stops future renewal charges after the current paid period. Unless required by law or stated in writing for a specific offer, unused monthly capacity does not roll over and is not automatically refunded.
Refund requests should be submitted within seven days of the first paid activation, with the account email, plan name, payment reference, and reason for the request. Refund eligibility may depend on actual usage, service availability, promotional terms, and applicable law.
5. Teacher, Institution, and Student Responsibilities
Teachers and institutions are responsible for deciding whether Testanix is appropriate for their students, exams, and classes. They are also responsible for setting exam rules, communicating monitoring requirements, reviewing incidents fairly, and complying with their own institutional policies.
Teachers and institutions must collect any legally required student, parent, or guardian consent before using proctoring, phone workspace monitoring, class recording, concentration reporting, or similar features. Testanix provides technical tools, but the teacher or institution remains responsible for lawful use in their educational context.
6. Minors and Guardian Consent
Students under 18 should use Testanix only under the supervision or authorization of a parent, guardian, school, teacher, or educational institution. Where students are minors, the teacher or institution must ensure that appropriate notices and consents are obtained before assigning monitored exams or recorded classes.
Students should not be asked to provide unnecessary personal information. If a parent or guardian believes a minor's data has been collected without appropriate authorization, they may contact support@testanix.com for review and deletion assistance.
7. Monitoring, Recordings, and Ownership
Exam webcam analysis and class concentration monitoring are designed to run on the student's device where technically supported. Testanix may receive alert metadata, attention summaries, exam submissions, attendance data, and reports.
Phone workspace recordings for exams, when enabled, are uploaded for integrity review and retained according to the plan or trial limit. Class recordings, when enabled, are owned by the teacher or institution that initiated the recording, subject to applicable law and their own student notices.
Teachers and institutions retain ownership of their exam content, class materials, questions, recordings, and reports. They grant Testanix the limited rights needed to host, process, transmit, store, and support those materials as part of the service.
8. Acceptable Use
Users must not misuse Testanix, attempt unauthorized access, interfere with monitoring tools, harass participants, upload harmful content, impersonate others, violate exam rules, or use the service for unlawful purposes.
Testanix may suspend or restrict accounts, classes, exams, or recordings if we reasonably believe there is abuse, security risk, non-payment, legal risk, or serious violation of these Terms.
9. Service Availability, Suspension, and Downtime
Testanix is in early access. Features may change, be limited, or be temporarily unavailable. We work to keep the service reliable, but internet, browser, device, video infrastructure, database, hosting, and third-party provider issues may cause downtime or degraded performance.
We may suspend service for maintenance, security response, legal compliance, abuse prevention, or urgent reliability work. Where practical, we will communicate significant planned downtime or incidents through the website, dashboard, or email.
10. Account Closure and Data Deletion
You may request account closure by contacting support@testanix.com. After account closure, Testanix will delete or anonymize personal data within a reasonable period, except where retention is required for legal, security, payment, audit, dispute, or backup purposes.
Exam evidence, phone recordings, class recordings, and reports may have shorter or longer retention depending on the plan, institutional configuration, legal requirements, or active disputes. Backup deletion may occur on a delayed cycle.
11. Complaints and Support Procedure
To submit a complaint, email support@testanix.com with your name, account email, role, institution if applicable, affected class or exam, screenshots or references if available, and a short description of the issue.
We aim to acknowledge complaints within a reasonable time and may request additional information before resolving the matter. Privacy complaints may also be handled under the Privacy Policy.
12. Governing Law
Subject to review by qualified legal counsel, these Terms are intended to be governed by the laws of Bangladesh, without regard to conflict-of-law principles. Courts or competent authorities in Bangladesh are expected to have jurisdiction unless a different arrangement is required by a signed institutional agreement or applicable law.
13. Changes to These Terms
We may update these Terms as Testanix moves through early access, paid launch, and institutional deployment. Material updates will be reflected by changing the effective date or version. Continued use of the service after an update means you accept the updated Terms.
