2. Description of Service

Testanix provides an online examination platform that includes:

Secure online test administration
AI-powered proctoring and monitoring
Performance analytics and reporting
User management and administrative tools

3. User Accounts and Registration

3.1 Account Creation

You must provide accurate and complete information during registration
You are responsible for maintaining the confidentiality of your account credentials
You must notify us immediately of any unauthorized use of your account

3.2 Account Types

Educators: Create and manage examinations
Students: Take assigned examinations
Administrators: Manage institutional accounts and users

4. Acceptable Use Policy

4.1 Permitted Uses

Creating, administering, and taking online examinations
Accessing performance analytics and reports
Managing user accounts within your institution

4.2 Prohibited Uses

Attempting to cheat or circumvent proctoring measures
Sharing account credentials or exam content
Reverse engineering or attempting to hack the platform
Using the service for any illegal or unauthorized purpose
Uploading malicious software or harmful content

5. Examination Integrity

5.1 Proctoring Consent

By taking an examination, you consent to:

Screen monitoring and phone recording when required for proctoring
Limited webcam monitoring for automated proctoring checks (used for presence and integrity checks only)
Behavioral analysis using AI technology to detect potential integrity violations
Review of relevant exam session materials by authorized personnel when an integrity issue is flagged

Important privacy notes: Phone recordings captured for proctoring focus on the device screen area, keyboard interactions, and the back side of the screen as visible to the phone camera. We do not intentionally record or store facial images or facial biometric data. Webcam captures are used for automated monitoring only and are not used to create facial profiles or biometric records.

5.2 Academic Integrity

You must take examinations independently unless otherwise specified
Use of unauthorized materials or assistance is prohibited
Violations may result in exam invalidation and account termination

6. Payment Terms

6.1 Subscription Plans

Fees are charged according to your selected subscription plan
Payments are processed through secure third-party providers
All fees are non-refundable except as explicitly stated

6.2 Free Trial

Free trials are limited to new customers
Trial periods automatically convert to paid subscriptions unless cancelled
You may cancel during the trial period without charge

7. Intellectual Property

7.1 Platform Ownership

Testanix retains all rights to the platform, including software, design, and technology.

7.2 User Content

You retain ownership of examination content you create
You grant us a license to use your content for service provision
You are responsible for ensuring you have rights to any content you upload

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. We do not sell user data to third parties.

9. Service Availability

9.1 Uptime

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service availability.

9.2 Maintenance

We may perform scheduled maintenance with advance notice to users.

10. Limitation of Liability

To the maximum extent permitted by law, Testanix shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

11. Indemnification

You agree to indemnify and hold harmless Testanix from any claims arising from your use of the platform or violation of these terms.

12. Termination

You may terminate your account at any time by contacting customer support.

12.2 Termination by Us

We may terminate accounts for violations of these terms or for any reason with 30 days' notice.
